Birth Injuries

an infant in ICUThe birth of child should be a wonderful experience. Sadly, it can become the most horrific event of your life. Injuries to a new-born child can occur for many reasons:  a delay in providing the correct diagnosis, the incorrect delivery procedure, and unmonitored or defective equipment used for monitoring the unborn child's heart beat.

Mistakes that occur during the birthing process are often times completely preventable. Brain injuries can arise due to the delay in the doctor arriving at the hospital when requested, delay in performing a cesarean section or a delay of the nursing staff in following the standard procedures and practices or orders of the doctor. This is medical negligence.

Birth injuries are devastating to everyone involved. These injuries present emotional, physical, and financial challenges for the entire family. A child with a birth injury may require life long care and treatment that is very costly and extremely physically and emotionally burdensome.

Many parents are initially unaware that their child has been harmed by medical negligence. Doctors, nurses and hospitals are reluctant to inform parents that they may have done something that caused an injury to their child. Some of the birth injuries that may indicate malpractice during delivery are:

  • Cerebral Palsy/Brain Damage
  • Erb's Palsy
  • Shoulder dystocia or brachial plexus
  • Cephalohematoma, or bleeding in the fetus' brain

We have represented families whose children have suffered from these devastating injuries. We understand what a stressful time this can be and the heartache that is felt. We will use our experience, knowledge and resources to obtain fair compensation for the parents and the injured children who are victims of birth injuries.

Injured minor children have until their 19th birthday to file their lawsuit. Their parents have two (2) years to file their suit for medical bills and other damages.
